Fish Clips Terms of Service
Effective date: August 15, 2026
These Terms of Service ("Terms") are a legal agreement between you and Fish Clips ("Fish Clips," "we," "us," or "our") about your use of the Fish Clips mobile app and related services (the "Service").
By creating an account, using the Service, or submitting a clip, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Fish Clips is a creator program. You may record a fishing catch clip in the app, submit it for review, and, if we approve it, we may edit it, publish it on our brand accounts, use it in marketing, and pay you under these Terms.
Fish Clips is not a social network. We do not promise that every clip will be approved, posted, or paid beyond what these Terms and the rates shown in the app provide.
2. Eligibility
You must be at least 18 years old to use the Service.
You may keep only one account, and it must be your own. Sign-in is through Google. You must provide a true and current Venmo or Cash App handle if you want payouts.
We may refuse, suspend, or ban any account at our discretion, including for breach of these Terms or activity that harms the Service or other users.
3. Accounts and Security
You are responsible for the Google account you use to sign in and for activity under your Fish Clips account.
Tell us right away at jayson@fishclipsapp.com if you think someone else has used your account. We may suspend or close accounts that are banned, inactive, or in breach of these Terms.
4. Content You Submit
When you submit a clip, you represent and warrant that:
- You recorded the footage yourself and own the rights needed to grant the license in Section 5.
- The clip follows our recording rules: portrait orientation, about 15 to 60 seconds, fish clearly in frame, and the catch or reel visible on camera.
- You have all rights and permissions for anyone shown, any location, music, logos, or other third-party material in the clip.
- The clip is not illegal, stolen, staged as a fake catch, or copied from someone else.
- You will not submit spam, near-duplicates, or content meant only to game approval or pay.
We may update recording rules in the app. Following the rules does not guarantee approval.
5. License to Fish Clips
You keep ownership of your raw clip.
By submitting a clip, you grant Fish Clips a worldwide, perpetual, irrevocable, royalty-bearing (as paid under these Terms), sublicensable, and transferable license to:
- Edit, crop, stabilize, overlay text, add bumpers or end cards, and otherwise modify the clip.
- Post and distribute the edited clip on social platforms, including but not limited to YouTube, TikTok, Instagram, and Facebook, and on any other platforms we use later.
- Use the clip in marketing on those platforms and in Fish Clips ads, website, app, press, and similar promotional materials.
- Use your name, handle, and likeness as they appear in the clip or your account profile in connection with the clip and our marketing of it.
- Monetize the posted clip on Fish Clips brand accounts, including platform ads and brand deals.
Platform ad revenue and brand-deal revenue from Fish Clips accounts belong to Fish Clips unless we agree otherwise in a separate writing. Your pay is only the amounts described in the Payments and Payouts sections.
We are not required to credit you, post your clip, or keep a posted clip online. We may remove a clip at any time.
6. Video Approval
Submitting a clip is an offer for us to consider it. Approval or decline is at Fish Clips' sole discretion, even if the clip follows our guidelines.
Review often takes about 24 hours, but that timing is not guaranteed.
Declined clips earn no pay. We may give a decline reason, but we do not have to. There is no in-app appeal process.
We may delete declined files from our storage. Approval does not guarantee that we will post the clip or that it will earn views.
7. Payments
We pay only for approved clips, at the rates then shown in the app. Current rates (which may change) are:
- Approval pay: $3.00 per approved video.
- View pay: $0.10 per 1,000 views after we post the edited clip on Fish Clips brand accounts and begin counting views.
- Bonuses: Optional extra pay for high-performing or standout content. Bonuses are decided by Fish Clips and are not guaranteed.
View pay is based on view totals we record from the platforms where we post the clip. We may combine views across those platforms as shown in the app.
Rates may change going forward. Amounts already credited stay at the rate that applied when they were earned.
We do not pay for declined clips. We do not pay view amounts for clips we never post. If we remove a clip, you keep amounts already credited unless we reverse them under these Terms.
We may withhold or reverse pay for fraud, ineligible content, chargebacks or payment errors, or breach of these Terms.
8. Payouts
You need a balance of at least $10.00 before we issue a payout. Balances under the minimum roll into the next weekly period.
Payouts are sent by Venmo or Cash App to the handle you set in the app. Keep that handle correct. We are not responsible for delays or losses caused by a wrong handle, a closed payout account, or Venmo or Cash App.
We aim to pay after each weekly close. Exact send timing can vary and depends on our processing and the payout services.
If a payout cannot be delivered after reasonable efforts, we may hold the amount or treat it as forfeited to the extent allowed by law.
9. Taxes and Independent Contractor Status
You are an independent contractor, not an employee, partner, or agent of Fish Clips.
You are responsible for all taxes on amounts you receive. We may require tax information or forms before we pay you, and we may withhold amounts as required by law.
10. Prohibited Conduct
You agree not to:
- Post or submit illegal, harmful, harassing, or infringing content.
- Impersonate anyone or misrepresent your identity or catches.
- Use malware, scrape the Service, or interfere with our systems.
- Create multiple accounts or fake views, engagement, or submissions.
- Try to game approval, view counts, or payouts.
- Violate fishing laws or any other applicable law in connection with your clips.
11. Fish Clips Property
The Service, app, Fish Clips name and branding, bumpers, overlays, brand accounts, and related materials are owned by Fish Clips or our licensors.
We grant you a limited, personal, revocable, non-exclusive license to use the app only to record and submit clips and manage your account under these Terms. You may not copy, reverse engineer, or exploit the Service except as allowed by law.
12. Privacy
We collect account information, clips, device data needed to run the app, and payout details so we can operate the Service and pay you. Camera and microphone access are required to record.
Contact us at legal@fishclipsapp.com with any further privacy questions.
13. Termination
You may stop using the Service at any time.
We may suspend or ban your account for breach of these Terms or for any reason allowed by law.
The license you granted for clips already submitted survives termination. Earned unpaid balances at or above the minimum will be paid in the normal payout cycle unless we withhold them for breach, fraud, or as required by law.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT ALLOWED BY LAW, FISH CLIPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not promise earnings, views, posting, approval, or uninterrupted or error-free Service.
15. Limitation of Liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, FISH CLIPS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS WE PAID YOU IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF WE PAID YOU NOTHING IN THAT PERIOD.
Some places do not allow certain limits. In those places, our liability is limited to the fullest extent allowed.
16. Indemnification
You agree to defend, indemnify, and hold harmless Fish Clips and our officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your clips, your use of the Service, your breach of these Terms, or your violation of law or third-party rights.
17. Changes to These Terms
We may update these Terms. We will post the updated Terms and update the effective date. Continued use of the Service after notice means you accept the updated Terms.
Material changes to pay rates apply going forward and will be shown in the app. They do not change amounts already credited at older rates.
18. General
These Terms are the entire agreement between you and Fish Clips about the Service and replace prior agreements on the same subject.
If a court finds any part of these Terms unenforceable, the rest still applies. Our failure to enforce a right is not a waiver.
You may not assign these Terms without our consent. We may assign them in connection with a merger, sale, or reorganization.
There are no third-party beneficiaries of these Terms except as stated for indemnified parties.
These Terms are governed by the laws of Indiana, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Indiana for disputes arising from these Terms or the Service, unless a later version of these Terms adds arbitration or another process.
